Dr. Mohammed Gomaa, Of Counsel, has achieved the Ph. D, LL.M. (Geneva University - IUHÉI), LL.B. and B.A. (commerce and accounting). He is Head of the Arbitration Department at ZH&P with practical and academic legal experience of over 30 years.
He is Sole Arbitrator, Party Appointed Arbitrator and Counsel in many local and international commercial arbitrations, under the UNCITRAL Rules, ICC, LCIA, DIAC, CRCICA and SIAC, involving both public or private entities relating, inter alia, to construction, commercial agencies, acquisition of shares, sale and purchase transactions, telecommunications, hotel management and hospitality, shipbuilding, charter parties and insurance.
Dr. Gomaa is Member of the Consultative Committee of the Cairo Regional Centre for International Commercial Arbitration (“CRCICA”) and Member of the Drafting Committee for the current Arbitration Rules and Sometime Legal Counsellor of the CRCICA.
He practices in the fields of arbitration, mega infrastructure projects (including PPPs), contracts and international treaties, general corporate law and Public International Law. He was legal advisor to the Government of Egypt in the negotiations and drafting of an Egyptian-Chinese development and usufruct contract for the first Economic Zone in Egypt, 2009-2011 and has drafted the first PPP tender package in Egypt for the construction and operation of public schools, 2007-2008.
Dr. Gomaa was also “Assistant to the Agent” of the Government of Egypt to the Egypt-Israel Arbitration Tribunal for the Taba Arbitration Case, 1987-89 and member of the Egyptian delegation in the “Taba Talks” between Egypt and Israel, 1985-1987, resulting in the conclusion of the Compromis d’arbitrage. He represented the League of Arab States (“LAS”) before the International Court of Justice (“ICJ”) in the Advisory Opinion of the “Wall”, in both the written and oral proceedings, 2003-2004 and drafted the Written Statements of Egypt in the Advisory Opinion of the ICJ on the “Legality of the threat or use of nuclear weapons”, 1995-1996. He also advised the Secretary General of the LAS on several international legal matters, 2003-2009. Dr. Gomaa was the Legal Counsel of the Egyptian delegation to the Egyptian-Israeli-Palestinian meetings for the operation of the Gaza Airport, 1997. Furthermore, he is frequently consulted by the Egyptian Foreign Ministry, as well as foreign embassies and diplomatic agencies accredited in Cairo. Arbitrator of the Court of Arbitration for Sport (CAS), 2010-2015.
He served for more than twenty years in different legal posts in the Egyptian Foreign Ministry where he ended his diplomatic career as Deputy Permanent Representative and Legal Adviser of Egypt to the United Nations in New York. He is also former Member, Legal and Technical Commission of the International Seabed Authority. Dr. Gomaa is a Visiting Professor of International Law at the School of International Studies of the University of Trento (Italy) – as well as intermittently Adjunct Professor of International Law at the American University in Cairo. He is Proficient in Arabic, English and French.
